1. Acceptance of Terms
By accessing or using Tech Aide ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these Terms, do not use the App.
2. Nature of the App
Tech Aide is a technical reference, educational, and workflow tool designed for radiologic technologists and imaging professionals. The App may provide radiographic positioning and projection references, technique-factor reference ranges, anatomy and evaluation-reference information, Favorites, Routines and Routine Builder, Equipment Profiles, Waypoint credential and continuing-education organization, Vault document storage, and other workflow and organizational tools.
Tech Aide is not a medical device. It is not intended for diagnosis, treatment planning, clinical decision support, or direct patient-care decisions. No feature guarantees image quality, diagnostic quality, compliance, credential validity, continuing-education compliance, or clinical outcomes.
3. Professional and Educational Use
Tech Aide is intended for radiologic technologists, radiography students, educators, and other appropriately trained users. Users are responsible for practicing within their education, credentials, scope of practice, supervision requirements, facility policies, and applicable laws and regulations.
4. Medical and Clinical Disclaimer
The information provided by the App is for educational and reference purposes only. It is not medical advice and is not a substitute for professional judgment, employer or facility protocols, manufacturer instructions, qualified supervision, or applicable laws and regulations.
Information may be incomplete or contain errors. Technique factors, positioning parameters, and protocols vary by institution, equipment, patient habitus, and clinical indication. Users must independently verify information before relying on it in a clinical setting.
5. Pediatric Technique Disclaimer
Pediatric exposure factors require particular caution due to the increased radiosensitivity of pediatric patients. Pediatric technique values in the App are approximate reference ranges derived from general guidelines. Pediatric techniques must always be verified against supervising-radiologist guidance and facility-specific pediatric protocols.
6. Tech Aide Pro Subscriptions and Payments
Tech Aide may offer optional monthly and yearly auto-renewable Tech Aide Pro subscriptions. Current plans, prices, billing periods, and included features are displayed in the App before purchase.
iOS purchases are billed by Apple to the user's Apple Account at confirmation. Subscriptions renew automatically under Apple's App Store subscription rules unless canceled. Users manage or cancel subscriptions through their Apple Account subscription settings.
Canceling auto-renewal does not immediately terminate access; Pro features remain available through the end of the paid period. Deleting a Tech Aide account or deleting the App does not cancel an Apple subscription. Restore Purchases asks Apple and Tech Aide's entitlement service to recognize an eligible purchase. Payments, renewals, billing disputes, and refunds remain subject to Apple's applicable terms and policies.
7. Account Responsibilities
Some features may be used without an account. When using an account, you are responsible for providing accurate information, maintaining the confidentiality of your sign-in credentials, using only accounts you are authorized to use, and promptly reporting suspected unauthorized access.
8. Acceptable Use
You may not misuse the App or its services, attempt unauthorized access, interfere with security or availability, reverse engineer the service where prohibited by law, infringe the rights of others, or use the App for unlawful, harmful, or fraudulent purposes.
Tech Aide is not intended to store patient-identifiable information or protected health information (PHI). You must not enter or upload patient names, medical record numbers, identifiable patient images, or other PHI.
9. User-Generated Content
Users may create, save, sync, or upload content through features such as Favorites, custom Routines, Equipment Profiles, Waypoint credentials, continuing-education activities, Vault documents, notes, and other user-created records.
Users retain ownership of their content and grant Tech Aide a limited license to store, process, display, transmit, back up, and sync that content as needed to operate the App. Users are responsible for the accuracy, legality, appropriateness, and authorization of content they enter or upload. Tech Aide does not verify credential validity, continuing-education compliance, or document authenticity.
10. Account Termination and Service Access
Users may stop using the App or request account deletion. Tech Aide may suspend, restrict, or terminate access if a user violates these Terms, misuses the service, attempts unauthorized access, uploads prohibited material, or creates legal or security risk.
Deleting a Tech Aide account does not cancel Apple subscriptions. Users remain responsible for canceling subscriptions through Apple if they no longer want to be billed.
11. Data Privacy
Some App data and settings are stored locally on the user's device. Sign-in is optional for supported features. Signed-in users may synchronize selected user-created information, including Favorites, custom Routines, Equipment Profiles, Waypoint credentials and continuing-education activities, Vault documents, and other supported records.
The collection, processing, storage, retention, and deletion of information through Tech Aide are described in the Tech Aide Privacy Policy.
12. Intellectual Property and Third-Party Materials
Tech Aide's original content, branding, design, and code are owned by the App developer and protected by applicable law. Users may not reproduce, distribute, modify, or create derivative works from that material except as permitted by law or with prior written permission.
The App may include or reference third-party or licensed materials. Those materials remain subject to their respective owners' rights, licenses, terms, and attribution requirements.
13. Assumption of Risk and Professional Judgment
You acknowledge that radiographic imaging involves inherent risks, including radiation exposure. You assume responsibility for professional and clinical decisions made in your practice, including technique selection, patient positioning, and exposure parameters. Tech Aide is a reference tool only.
14. Availability and Service Changes
Tech Aide may modify, suspend, or discontinue features or services. Access may be interrupted by maintenance, device limitations, connectivity, third-party services, or circumstances outside Tech Aide's control. Tech Aide does not guarantee uninterrupted availability or that reference information will always be exhaustive, current, or error-free.
15. Disclaimer of Warranties
The App is provided "as is" and "as available," to the fullest extent permitted by law, without warranties of any kind, express or implied. The developer does not warrant that the App will be uninterrupted, error-free, complete, or free of harmful components.
16. Limitation of Liability and Indemnification
To the fullest extent permitted by law, the App developer and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, use, profits, goodwill, or other intangible losses arising from use of or inability to use the App or reliance on its content.
You agree to defend, indemnify, and hold harmless the App developer and its affiliates from claims, liabilities, damages, losses, and expenses arising from your misuse of the App, violation of these Terms, violation of another party's rights, or content you enter or upload, to the extent permitted by law.
17. Changes to Terms
These Terms may be updated as Tech Aide, its services, or applicable requirements change. Material changes may be communicated through the App or other appropriate means. Continued use after an update constitutes acceptance of the updated Terms where permitted by law.
18. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law.
